1. Acceptance of Terms
By registering for, bidding on, or using SCC Texoma Auctions LLC in any manner, you agree to be bound by these Terms and Conditions, as well as any additional rules, policies, or notices posted on the site. If you do not agree, you may not register or participate in auctions.
2. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. You agree to provide accurate, current, and complete information during registration and to update your information as needed.
3. Bidding & Auction Rules
All bids are binding. Once a bid is placed, it cannot be retracted. The highest bidder at the close of an auction enters into a binding obligation to purchase the item.
Bidders are responsible for reviewing item descriptions, photographs, pickup requirements, and shipping availability prior to bidding. Failure to read listing details does not release a bidder from their obligations.
4. Payment, Taxes & Non-Payment
Payment is due in accordance with the auction’s posted pickup and payment terms. Failure to submit payment or make payment arrangements within the required timeframe constitutes non-payment.
Final purchase prices may be subject to applicable local and state sales taxes. Buyers are responsible for all required taxes unless a valid tax-exempt form is provided prior to payment.
User accounts may be suspended or permanently banned for non-payment if arrangements are not made. SCC Texoma Auctions LLC reserves the right to cancel bids, void sales, forfeit payments, relist items, and recover any losses or fees resulting from non-payment.
5. Item Condition & No Warranties
All items are sold AS IS, WHERE IS, with no warranties or guarantees of any kind, expressed or implied. Descriptions, photographs, and condition statements are provided as a guide only.
SCC Texoma Auctions LLC makes no representations regarding the condition, authenticity, completeness, or functionality of any item. Buyers are encouraged to ask questions or preview items prior to bidding.
6. Pickup, Shipping & Abandoned Items
Buyers are responsible for complying with all posted pickup and shipping terms. Items not picked up within the specified timeframe and without prior arrangements may be considered abandoned.
Abandoned items may be resold, relisted, or otherwise disposed of at SCC Texoma Auctions LLC’s discretion. Any payments made may be forfeited, and buyers may remain responsible for associated costs.
7. Limitation of Liability
SCC Texoma Auctions LLC acts as a marketplace platform connecting buyers and sellers. We are not responsible for the quality, safety, legality, or fitness for a particular purpose of items offered for sale.
To the fullest extent permitted by law, SCC Texoma Auctions LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in any auction or use of the site.
8. Prohibited Conduct
Users may not engage in bid manipulation, shill bidding, harassment, abuse, fraudulent activity, or any conduct that disrupts the auction process. Any such activity may result in immediate account suspension or termination.
9. Privacy
Personal information collected through SCC Texoma Auctions LLC is handled in accordance with our Privacy Policy. By using the site, you consent to the collection and use of information as described therein.
10. Changes to Terms
SCC Texoma Auctions LLC reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on the site, and continued use of the platform constitutes acceptance of those changes.
